AquaStar Privacy Policy Overview

At AquaStar Distributors (“AquaStar,” “we,” “us,” or “our”), we appreciate the trust you place in us when you choose to visit our website, aquastardistributors.com, or call us on the phone. This Privacy Policy (the “Policy”) describes how we collect, use, and protect personal information about you.

By “personal information,” we mean information that directly identifies you, such as your name, address, or email address. In this Policy, “you” means any person who visits our website or contacts us.

We review and update this Policy at least once every twelve (12) months, and more often as needed, to ensure it reflects our current data practices and remains compliant with evolving privacy laws, including the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), and the EU General Data Protection Regulation (GDPR).

What Information We Collect

We collect a variety of types of information, including:

  • Purchase information, such as the items you purchase, custom orders (including measurements/specifications), payment method and payment information (such as debit or credit card details processed via our payment processor), billing and shipping address, and order-related contact information (such as for receipts or shipping updates);
  • Preference information, such as your contact and marketing preferences, and product interests;
  • Profile and account information, which may include Contact, Purchase, and Preference information, as well as your account password, wish list items, shopping cart contents, and product review information;
  • Demographic information, such as ZIP code or other information you voluntarily provide;
  • Photographic or video information you voluntarily submit, such as with a product review;
  • Call recordings, including information about your call and what you share when you call us;
  • Device and browsing information, including your IP address, browser type and settings, device identifiers, and information about how you navigate and use our website (“automatically collected information”).
  • Live chat conversations, including messages you send through our website’s chat widget, which is operated by our third-party live chat provider, tawk.to.

How We Collect Information

We collect information:

  • Directly from you, such as when you make a purchase, contact customer service, create an account, sign up for emails, or apply for employment;
  • From service providers, including our e-commerce platform, payment processor, shipping carriers, email/marketing platforms, and website analytics and advertising providers (for example, tools such as Google Analytics and Google Ads, which help us understand site usage and measure advertising performance);
  • Using cookies and similar technologies, including cookies, web beacons, pixels, and website log files. A cookie/tracking notice is presented on our website describing the categories of cookies in use and allowing you to manage your preferences where required by law.

We do not currently use session-replay recording technology on our website. If this changes, we will update this Policy and provide notice as required by applicable law.

How We Use Information

We use the information we collect to:

  • Fulfill orders and provide service — process payments, ship orders, manage your account, and respond to inquiries;
  • Personalize your experience — remember preferences and tailor the products we show you;
  • Market and advertise — send marketing communications and, where you have not opted out, show relevant advertising, including through Google Ads and similar platforms;
  • Analyze and improve our website — understand traffic and usage patterns via analytics tools such as Google Analytics;
  • Operate our business — maintain records, prevent fraud, and comply with legal obligations;
  • Meet legal and safety obligations — respond to legal process, enforce our terms, and address product safety/recall matters.

How We Share Information

We do not sell your personal information for money. We do not share personal information with third parties for their own independent marketing purposes without your consent.

We do share personal information with:

  • Service providers who perform functions on our behalf (e.g., payment processing, shipping/logistics, IT hosting, email delivery, analytics, and advertising measurement);
  • Our live chat provider, tawk.to, which processes chat conversations submitted through our website’s chat widget on our behalf;
  • Advertising and analytics partners, such as Google (Google Analytics and Google Ads), which may be considered “sharing” for cross-context behavioral advertising under the CPRA. See “Your Privacy Rights” below for how to opt out;
  • Parties involved in a business transaction, such as a merger, acquisition, or sale of assets;
  • Legal and safety authorities, when required by law, subpoena, or to protect the rights, property, or safety of AquaStar, our customers, or others.

Your Privacy Rights

California Residents (CCPA/CPRA)

If you are a California resident, you have the right to:

  • Know what personal information we have collected, used, disclosed, or sold/shared about you;
  • Delete personal information we have collected from you, subject to certain exceptions;
  • Correct inaccurate personal information we maintain about you;
  • Opt out of the sale or sharing of your personal information for cross-context behavioral advertising (see “Do Not Sell or Share My Personal Information” below);
  • Limit the use of sensitive personal information, where applicable;
  • Non-discrimination — we will not discriminate against you for exercising any of these rights.

To exercise these rights, contact us using the information in “Contact Us” below. We will verify your request before responding, consistent with legal requirements. Authorized agents may submit requests on your behalf with proof of authorization.

Do Not Sell or Share My Personal Information: You may opt out of the use of your data for cross-context behavioral advertising by adjusting cookie preferences in our cookie banner or by contacting us at the information below.

EU/UK Residents (GDPR)

If you are located in the European Union or United Kingdom, you have the right to access, correct, delete, restrict, or port your personal data, and to object to certain processing, including direct marketing. Our legal bases for processing include performance of a contract (fulfilling your order), legitimate interests (site security, analytics), and consent (marketing communications, non-essential cookies), consistent with GDPR Article 6. Consistent with GDPR Article 12, we keep this Policy accurate and up to date and will respond to verified rights requests without undue delay and in any event within one month.

Cookies and Tracking Technologies

We use cookies and similar technologies for essential website functionality, analytics (e.g., Google Analytics), and advertising measurement (e.g., Google Ads conversion tracking). We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including encrypting checkout and account pages via HTTPS. No method of transmission over the internet is completely secure, and we cannot guarantee absolute security.

Children’s Privacy

Our website is not directed to children under 13, and we do not knowingly collect personal information from children under 13 without verifiable parental consent. If you believe a child has provided us personal information, contact us and we will take steps to delete it.

International Customers

If you place an order that ships outside the United States, your personal information will be processed in the United States, where privacy laws may differ from those in your country. By using our website, you consent to this transfer and processing.

Changes to This Policy

We may update this Policy from time to time to reflect changes in our practices or applicable law. We will post the updated Policy on this page with a revised “Last Updated” date, and for material changes, we will provide additional notice (such as a website banner) where required by law.
